1 Introduction and Acceptance

Realise (the “Service”) is a habit-building app with AI-powered personalised coaching. Realise is a product of Project Me Ltd. (“we,” “us,” “our,” or “Company”), a limited company registered in England and Wales (Company Number 15973229).

These Terms of Use (“Terms”) form a contract between the Company and you, as a user of the Service. By creating an account, checking the acceptance box, or continuing to use our Service, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Service.

Important: Our app is currently in a testing phase. By using the Service during this period, you acknowledge that you are participating as a tester and that the Service is under development.

2 Definitions

  • Service” means our habit-building web application, mobile application and related services
  • User” or “you” means any person who accesses or uses our Service
  • AI” refers to our artificial intelligence chat feature powered by third-party services
  • Personal Data” has the meaning given in applicable data protection laws
  • Testing Phase” means the current development period during which the Service is provided free of charge to testers
  • Habit-Building” means the formation, modification, or maintenance of personal routines and behaviours
  • Input” means all information shared by the User while using the Service, including text sent using the chat feature and other in-app interactions but not including journal entries
  • User Content” means any content you create, input, or submit through the Service, including journal entries, chat messages, personal information, and goals you manually create
  • Generated Content” means content created by our AI based on your inputs, including AI chat responses, automatically generated habit names, goal descriptions, and personalised recommendations
  • Journal Entry” means only text inputted by the user using the Journal function and does not include any other interactions within the Service
  • Anonymised” means we have taken steps to irreversibly de-identify the personal data in question.
  • Commercial Use” means any use of the Service or its content for the purpose of monetary compensation, financial gain, advertising, promotion, or in connection with a business or other commercial enterprise
  • Data Processor” means a natural or legal person, public authority, agency or other body which processes personal data on our behalf. We are the Data Controller, which means we determine the purposes and means of processing personal data
  • Third Party Service Provider” means any unaffiliated person, company, or entity that performs services for the Company without having a stake, share or equity in the Company

3 Eligibility and Account Requirements

3.1 Age Requirements
  1. You must be at least 18 years old to use our Service
3.2 Geographic Restrictions
  1. Our Service may not be available in all countries
  2. You may not access or use the Service if you are located in, or a resident of, any jurisdiction where such access or use would be illegal or prohibited
  3. We reserve the right to restrict access from any jurisdiction where providing the Service would be illegal, impractical, or contrary to applicable laws or regulations
3.3 Account Security
  1. You are responsible for maintaining the confidentiality of your account credentials
  2. You must provide accurate and complete information when creating your account
  3. You must promptly update any changes to your information
  4. You are solely responsible for all activities under your account
3.4 Platform Compliance
  1. If you access our Service through third-party platforms (such as app stores or web browsers), you must also comply with their respective terms
  2. We are not responsible for any issues arising from your use of third-party platforms

4 Testing Phase Terms

4.1 Time Period
  1. Our Service is currently in a testing and development phase
  2. As a tester, you receive free access to the Service for monthly periods
  3. Your initial testing period is one month from account creation
  4. We may offer additional monthly testing periods at our discretion
4.2 Tester Requirements
  1. You agree to complete mandatory questionnaires before starting and after each monthly testing period
  2. Your usage patterns and interactions may be monitored for testing purposes. You can opt out of this by sending an email to privacy@realiseapp.uk
  3. Additional feedback is welcomed but not required
4.3 Development Acknowledgment
  1. You understand and accept that the Service is under active development
  2. Features may change, be removed, or function imperfectly during testing
  3. We have made reasonable efforts to provide a quality experience, but cannot guarantee the Service will always work as expected
  4. While we take reasonable care to provide the Service as described, you use it at your own discretion and risk

The Service is provided for testing and feedback purposes only and is not a commercial release

4.4 No Liability During Testing
  1. During the testing phase, we expressly disclaim all liability for any issues, problems, or damages arising from your use of the Service, to the extent permitted by law and subject to section 11 of these Terms
  2. This includes but is not limited to: technical failures, data loss, inappropriate AI responses, or any other service-related issues
  3. You acknowledge that participation in testing inherently involves risks
  4. Nothing in these Terms affects your rights to seek remedies under UK consumer law if we fail to provide our Service with reasonable care and skill

5 Service Description and AI Limitations

5.1 What We Provide
  1. AI-powered habit-building coaching and support
  2. Personal journaling features (private to you)
  3. Progress tracking and goal setting
  4. Personalised recommendations based on information you share
5.2 What We Do Not Provide
  1. Medical, mental health, or therapeutic services
  2. Professional counselling, psychology, or psychiatric services
  3. Medical, financial, legal, or other professional advice
  4. Crisis intervention or emergency mental health services
  5. Guaranteed outcomes or results
5.3 AI-Specific Limitations
  1. Any suggestions or recommendations generated by artificial intelligence are for general informational purposes and are not a substitute for professional or individual judgment
  2. Our chat responses and auto-generated content such as goal titles and descriptions are generated by artificial intelligence and are not professional advice of any kind
  3. AI responses may contain errors, be inappropriate, or be misinterpreted
  4. AI may produce responses that appear accurate but contain errors or “hallucinations.” You must carefully review and validate all AI output before relying on it for any decision-making
  5. AI responses cannot replace human judgment, professional consultation, or personal decision-making
  6. You are solely responsible for evaluating and acting upon any AI-generated suggestions
  7. If you are experiencing a mental health crisis or emergency, immediately contact emergency services or a mental health professional (see 5.4)
5.4 Mental Health Considerations
  1. If you are struggling with mental health issues, please consult qualified mental health professionals
  2. Our Service is not designed to detect, treat, or manage mental health conditions

6 User Responsibilities and Prohibited Uses

6.1 Your Responsibilities
  1. You may use the App only for your personal, non-commercial habit-building purposes
  2. You may not use the App or any content available through it for any commercial purpose, including but not limited to advertising, solicitation, resale, or offering services to others for a fee
  3. You must provide accurate information in your interactions
  4. You must think critically about any suggestions or information provided
  5. You must seek appropriate professional help when needed
  6. You must respect the testing nature of the Service
6.2 Prohibited Activities

You may not:

  1. Use the Service for any illegal or unauthorised purpose
  2. Share harmful, abusive, threatening, or inappropriate content
  3. Attempt to reverse engineer, hack, or compromise the Service
  4. Share your account credentials with others
  5. Use the Service for commercial purposes during the testing phase
  6. Submit false or misleading information
  7. Interfere with other users’ access to the Service

7 Content and Intellectual Property

7.1 Your Content
  1. You own all User Content you create, including your Input, Journal Entries and personal information you share
  2. Your Journal Entries are private and are not accessed by our AI, employees or contractors as these are stored separately from your Input
  3. Your Input may be used to personalise your experience and create Generated Content visible only to you and our AI
  4. By using the Service, you grant us a non-exclusive, royalty-free, worldwide license to:
    • Process your Input to provide the Service and create Generated Content, for the duration of your account
    • Use your Input and anonymised usage patterns to improve our Service
7.2 Our Intellectual Property
  1. We own all rights to the Service, including our app, algorithms, branding, and proprietary technology
  2. You receive a limited, non-exclusive license to use the Service for personal purposes only
  3. You may not copy, reproduce, distribute, or create derivative works from our Service
  4. We use third-party services (including Anthropic API) which are subject to their respective terms
7.3 Consent for Data Use
  1. By agreeing with these Terms and our Privacy Notice, you consent to us using your Input and anonymised usage patterns to improve our Service unless consent is withdrawn
  2. This consent is:
    • Voluntary – you can still use the Service if you decline
    • Specific – limited to service improvement purposes only
  3. If you consent, we may use:
    • User Input to improve Generated Content
    • Anonymised usage patterns to enhance features
    • Aggregated data for research and development
  4. Because we do not put limits on the information you choose to share in the chat feature, we cannot guarantee that chat history data will be fully anonymised. We strictly limit access to this data so that it is only used to improve our service, and user chat history will not be seen by a human unless consent is explicitly and separately given by the user. However, it is the user’s responsibility to be sensible about sharing any personal information in the chat feature.
  5. We will never use your identifiable personal information for service improvement without your explicit consent
  6. Withdrawal of consent does not affect the lawfulness of processing based on consent before withdrawal

8 Privacy and Data Protection

8.1 Data Handling
  1. We collect personal information necessary to create and maintain your account
  2. Chat data and habit information you share directly (Input) is used to provide personalised services
  3. If you consent, we may use your Input data to improve our Service performance
  4. Your Input when using the Service is processed by our third-party service provider Anthropic, and is processed under their terms
8.2 International Data Transfers
  1. We use third-party service providers that may process your data in countries other than your own (see list of third-party data processors in Privacy Notice)
  2. These providers may transfer data internationally as part of their services
  3. We select service providers that represent they comply with applicable data protection laws and implement appropriate safeguards
  4. By using our Service, you acknowledge that such international processing may occur

9 Service Availability and Modifications

9.1 Availability
  1. We strive to provide continuous access to the Service but cannot guarantee uninterrupted availability
  2. The Service may be temporarily unavailable due to maintenance, updates, or technical issues
  3. We will make reasonable efforts to provide advance notice of planned service interruptions via email and/or prominent in-app notification
9.2 Modifications
  1. We may modify, update, or discontinue features of the Service at any time during the testing phase
  2. We may add new features without notice if they do not affect your use of existing features
  3. Significant changes affecting existing functionality will be communicated with at least two weeks’ notice

10 Updates to Terms

We may update these Terms from time to time. We will provide at least two weeks’ notice of material changes via email, except for updates that only affect new features and do not impact your use of existing features, which may be implemented immediately.

Your continued use of the Service after any updates constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you should discontinue use of the Service before the effective date of the change.

11 Limitation of Liability and Disclaimers

11.1 Non-Excludable Liability

Nothing in these Terms excludes or limits our liability for:

  1. Death or personal injury caused by our negligence
  2. Fraud or fraudulent misrepresentation
  3. Breach of the obligation to perform services with reasonable care and skill under Section 49 of the Consumer Rights Act 2015, consistent with the testing nature of the service
  4. Any other liability that cannot be excluded or limited under applicable law
11.2 Testing Phase Disclaimer

SUBJECT TO SECTION 11.1, DURING THE TESTING PHASE, THE SERVICE IS PROVIDED “AS IS” AND WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, BEYOND THOSE REQUIRED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM LIABILITY FOR DAMAGES, LOSSES, OR ISSUES ARISING FROM YOUR USE OF THE SERVICE, EXCEPT WHERE SUCH EXCLUSION WOULD BE UNLAWFUL.

11.3 General Disclaimers

Subject to Section 11.1:

  1. We do not warrant that the Service will meet your specific requirements
  2. We implement appropriate technical and organisational measures to protect your data, but cannot guarantee absolute security against all threats
  3. We do not guarantee that the Service will be error-free or continuously available
  4. You use the Service at your own risk and discretion
  5. We are not responsible for any decisions you make based on AI-generated content or Service features, except where we have been negligent
11.4 Third Party Service Providers
  1. We take reasonable care in selecting and monitoring third-party service providers (including AI services) who represent they comply with applicable data protection and security requirements
  2. While we exercise reasonable care in selecting processors, we cannot control their independent actions and are not liable for events entirely beyond our reasonable control, except where we have failed to exercise reasonable care in selection or oversight
  3. For the avoidance of doubt, we remain responsible as data controller for ensuring appropriate safeguards are in place
11.5 Limitation of Damages

Subject to Section 11.1, during the testing phase:

  1. Our total liability for any claims arising from or relating to the Service (other than those specified in Section 11.1 or where prohibited by law) is limited to zero pounds (£0)
  2. We shall not be liable for any indirect, incidental, special, consequential, unforeseeable, or punitive damages
  3. This limitation applies even if we have been advised of the possibility of such damages
11.6 User Assumption of Risk

You acknowledge and agree that:

  1. Habit-building involves personal responsibility and decision-making
  2. AI technology has inherent limitations and potential for error
  3. Professional advice should be sought for serious personal, health, or safety matters
  4. You are solely responsible for your actions and decisions based on the Service
  5. The Service is intended as a support tool only and does not replace professional judgment

12 Account Termination and Enforcement

12.1 Your Right to Terminate
  1. Upon your request, we will delete or anonymise your personal data within 30 days in accordance with our Privacy Notice
  2. Some data may be retained as required by law or for legitimate business purposes (such as fraud prevention)
  3. Input data used for service improvement may be retained as described in Section 7.3
12.2 Our Enforcement Process

If we believe you have violated these Terms, we will generally follow this process (except in urgent cases under Section 12.4):

  1. We will investigate the alleged violation and notify you via email, explaining:
    • The nature of the violation
    • Potential consequences
    • Your right to respond within 7 days
  2. Depending on severity, we may:
    • Issue a warning for minor or first-time violations
    • Temporarily suspend your account (typically 7-30 days)
    • Restrict specific features while maintaining basic access
    • Permanently terminate your account for serious or repeated violations
12.3 Appeals Process
  1. Your appeal must include your account details, the decision being appealed, and reasons why you believe it was incorrect
  2. We will review your appeal and respond within 14 days
  3. Where practicable, appeals will be reviewed by someone different from the original decision-maker
12.4 Immediate Termination Without Notice

We may terminate your account immediately without prior notice if you:

  1. Engage in illegal activity through the Service
  2. Pose immediate risk to safety or security of users
  3. Attempt to hack or compromise the Service
  4. Engage in fraud or serious abuse
  5. Violate commercial use prohibitions causing material harm
  6. When required by law or court order

Even in immediate termination cases, we will notify you of the termination and reasons within 48 hours and provide reasonable opportunity to retrieve your personal data unless legally prohibited or where doing so would compromise security.

12.5 Effects of Termination

Upon account termination (by either party):

  1. Your access to the Service will cease immediately
  2. You will no longer be able to access your account or data within the Service
  3. Your obligations under these Terms regarding prohibited uses continue to apply
  4. Data handling will follow the timelines specified in Sections 12.1 (your termination) or 12.2(c) and 12.4 (our termination)
  5. During the testing phase (free service), no refunds apply
  6. These sections survive termination: Sections 7, 8 (for retained data), 11, 13, 14, and 12.5
12.6 Fairness and Discretion
  1. We strive to apply enforcement procedures consistently and fairly across all users
  2. We reserve discretion to consider individual circumstances when determining appropriate action
  3. Nothing in these procedures affects your statutory consumer rights under applicable law

13 Dispute Resolution and Governing Law

13.1 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

3.2 Dispute Resolution

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any issues. Many concerns can be addressed through direct communication.

14 General Provisions

14.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.2 Entire Agreement

These Terms, together with our Privacy Notice, constitute the entire agreement between you and us regarding the Service.

14.4 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.5 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable law, including rights that cannot be excluded or limited by contract. This includes rights under consumer protection legislation, distance selling regulations, and other consumer laws that may apply to you.
